Small was born in Terre Haute, Indiana, United States, the son of Benjamin F. and Rose (MacFall) Small. He earned a Bachelor of Arts from Indiana State University in 1941, a Doctor of Laws in 1969, and a Juris Doctor with distinction from Indiana University in 1943.
